Terms of Service

Welcome to CAD Forge (“CAD Forge”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your use of our website, products, and services, including 3D printing, rapid prototyping, CAD design, product development, and related manufacturing services.
By submitting an order, requesting a quote, or using our services, you agree to these Terms.
Quotations and Orders
All quotations are valid for thirty (30) days unless otherwise specified.
An order is considered confirmed when:
- The customer accepts a quotation; and
- Any required deposit or payment has been received.
CAD Forge reserves the right to refuse any order at its sole discretion.
Payment Terms
Payment terms may vary depending on the project.
Unless otherwise agreed:
- Custom orders require payment in full or a deposit before production begins.
- Remaining balances must be paid before shipment or pickup.
- Prices are quoted in Canadian Dollars (CAD).
- Applicable GST, PST, or other taxes will be charged where required by law.
Failure to make payment may result in production delays, order cancellation, or withholding of completed products.
Customer-Supplied Files and Designs
Customers are solely responsible for the accuracy, legality, and suitability of all files, models, drawings, specifications, and instructions submitted to CAD Forge.
By submitting files, the customer represents and warrants that:
- They own or have authorization to use the submitted design.
- The design does not infringe any patent, copyright, trademark, trade secret, or other intellectual property rights.
- The design complies with all applicable laws and regulations.
CAD Forge does not verify ownership of intellectual property and assumes no responsibility for disputes arising from customer-submitted content.
Prohibited Items
CAD Forge reserves the right to reject any order involving:
- Firearms, firearm components, or ammunition
- Weapons or weapon accessories
- Illegal or controlled substances
- Counterfeit products
- Items intended to violate intellectual property rights
- Products that violate municipal, provincial, federal, or international laws
- Products that may pose unreasonable safety, environmental, or legal risks
CAD Forge may request additional information regarding a project’s intended use before accepting an order.
Manufacturing Tolerances
3D printing and additive manufacturing processes inherently involve dimensional variations and cosmetic imperfections.
Customers acknowledge that:
- Minor layer lines, surface marks, and material variations are normal.
- Color shades may vary between production batches.
- Exact dimensional accuracy cannot be guaranteed unless specifically agreed in writing.
- Mechanical properties may vary depending on material, geometry, and print orientation.
Unless otherwise specified, CAD Forge applies commercially reasonable manufacturing tolerances suitable for prototyping and general-use applications.
Product Testing and End-Use Responsibility
Customers are solely responsible for determining whether a product is suitable for its intended application.
Products supplied by CAD Forge are not certified for:
- Medical use
- Life-safety applications
- Aerospace applications
- Automotive safety-critical systems
- Structural engineering applications
unless explicitly stated in writing.
Customers must independently test and validate products before commercial, industrial, or public use.
Intellectual Property
The customer retains ownership of any intellectual property contained within customer-supplied files.
Unless otherwise agreed in writing:
- CAD Forge retains ownership of CAD models, manufacturing methods, tooling, fixtures, templates, and production processes created by CAD Forge.
- CAD Forge may retain archived project files for internal recordkeeping purposes.
No intellectual property rights are transferred except as expressly agreed in writing.
Confidentiality
CAD Forge will take reasonable measures to protect confidential customer information.
However, unless a separate Non-Disclosure Agreement (NDA) has been executed, CAD Forge does not guarantee absolute confidentiality.
Customers requiring enhanced confidentiality should request an NDA before sharing proprietary information.
Shipping, Delivery, and Pickup
Estimated production and delivery dates are provided for convenience only and are not guaranteed.
CAD Forge is not liable for delays resulting from:
- Equipment failure
- Material shortages
- Supplier delays
- Shipping carrier delays
- Events beyond our reasonable control
Risk of loss transfers to the customer upon pickup or delivery to the shipping carrier.
Inspection and Claims
Customers must inspect products upon receipt.
Any claims regarding:
- Manufacturing defects
- Missing items
- Incorrect products
must be reported within seven (7) days of delivery or pickup.
Failure to notify CAD Forge within this period constitutes acceptance of the order.
Returns and Refunds
Due to the custom nature of 3D printed and made-to-order products, all sales are generally final.
Refunds, replacements, or credits may be issued at CAD Forge’s discretion if:
- The product materially differs from approved specifications; or
- A manufacturing error attributable to CAD Forge occurred.
Normal wear, misuse, improper installation, design flaws supplied by the customer, or customer specification errors are not grounds for refund.
Limitation of Liability
To the maximum extent permitted by law, CAD Forge shall not be liable for:
- Indirect damages
- Consequential damages
- Lost profits
- Business interruption
- Loss of data
- Loss of opportunity
arising from the use of our products or services.
CAD Forge’s total liability shall not exceed the amount paid by the customer for the specific order giving rise to the claim.
Indemnification
Customers agree to indemnify and hold harmless CAD Forge, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:
- Customer-supplied designs
- Intellectual property disputes
- Product misuse
- Regulatory violations
- Customer negligence
Website Use
Users may not:
- Attempt unauthorized access to our systems
- Upload malicious software
- Use our website for unlawful purposes
- Interfere with website operation
CAD Forge reserves the right to suspend access to users who violate these Terms.
Privacy
Personal information collected through our website or services will be handled in accordance with our Privacy Policy and applicable privacy laws, including the British Columbia Personal Information Protection Act (PIPA).
Force Majeure
CAD Forge shall not be liable for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, labour disputes, government actions, supply chain disruptions, or utility failures.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
Changes to these Terms
CAD Forge may update these Terms at any time. Updated Terms will be posted on this website and become effective immediately upon publication.
